Terms of Service

These Terms of Service ("Terms") govern all purchases made from EliteStar Sport & Recovery ("EliteStar") at our retail showroom at 1051 Steeles Ave W, Toronto, ON M2R 2S9, Canada. For showroom inquiries, call 343-668-9507. By completing a purchase, you agree to these Terms.

1. In-Store Retail Model

EliteStar operates exclusively as a same-day, in-person retail business. Products are sold professionally, on the sales floor, at the time of transaction. We do not offer shipping, delivery, layaway, pre-orders, deposits, holds beyond one business day, or online checkout. Every item advertised is physically present in the showroom at the time of sale and is transferred to the customer immediately upon payment.

2. Inventory & Availability

Product availability, package contents, and pricing shown on this website are indicative only and reflect typical in-stock inventory. Actual availability is confirmed at the counter. Where a specific component of a package is unavailable, a substitute of equal or greater value may be offered, or the package will not be sold.

3. Prices, Taxes & Payment

All prices are in Canadian dollars and exclusive of Ontario HST (13%), which is added at the point of sale. Accepted payment methods and related terms are described in our Payment Policy. Payment is due in full at the time of purchase.

4. Transfer of Ownership & Risk

Ownership and all risk of loss or damage transfer to the customer at the moment the product leaves the showroom counter. The customer is solely responsible for transportation of purchased equipment from the showroom.

5. Final Sale

Because all products are inspected in person and released at the time of purchase, all sales are final. Exchanges or refunds are provided only where required by the Ontario Consumer Protection Act, 2002, or where a product is demonstrably defective as described below.

6. Manufacturer Warranties & Defects

Where a manufacturer warranty applies, it is passed through to the customer on its original terms. Suspected manufacturing defects must be reported to the showroom within seven (7) days of purchase, with the original receipt and product, for inspection. Wear from use, misuse, dropping, or exceeding the product's rated load is not covered.

7. Safe Use

Sport, strength, and recovery equipment carries inherent risk of injury. Customers are responsible for using each product in accordance with the manufacturer's instructions and, where appropriate, under the supervision of a qualified professional. EliteStar staff can provide general information but do not provide medical, physiotherapy, or coaching advice.

8. Limitation of Liability

To the maximum extent permitted by Ontario law, EliteStar's total liability arising out of any purchase is limited to the amount paid for the product giving rise to the claim. EliteStar is not liable for indirect, incidental, or consequential damages, including personal injury resulting from misuse of equipment.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Ontario.

10. Changes

EliteStar may update these Terms at any time. The version in effect at the time of your purchase governs that transaction.
